I. Subject Matter, Amendments

§ 1 Subject of the Terms and Conditions

(1) Voltimum UK & Ireland Ltd (hereinafter referred to as the "service provider") operates an information platform at www.voltimum.ie (hereinafter called "Voltimum").

The Voltimum information platform is aimed exclusively at professionals from the electrical industry; these are in particular entrepreneurs, their employees and trainees. Consumers are not allowed to register on Voltimum.

The participants can create individual personal profiles, retrieve content freely available on Voltimum and use the other free and current services available at Voltimum within the scope of the respective availability. Further information about the services can be found in the Service Description, § 8.

(2) These Terms and Conditions shall govern the provision of the Services by the service provider and the use of such Services by you as a properly registered Participant.

(3) Detailed information about the service provider can be found in our imprint.

§ 2 Modifications to these Terms and Conditions

(1) The service provider reserves the right, especially during the introduction of new services, to change these Terms and Conditions at any time with effectiveness even within the existing contractual relationships. The service provider shall inform you of any such modifications at least 30 calendar days before their scheduled date of coming into effect. If you do not object to a modification within 30 days of receipt of notice and continue to use the services even after the expiry of this deadline, the modifications shall be regarded as effective and agreed upon from the deadline onward. Should you object to a modification, the Contract shall remain valid with the prior conditions. The service provider shall inform you of your right to object and the subsequent consequences within the notice about the modification(s).

(2) In the event of changes in value added tax, the service provider is entitled to make an adjustment to the premium access fee corresponding to this change, without the existence of the aforementioned right of objection.

II. Participant Registration, Handling of Access Data, Termination of Participation

§ 3 Registration Authorisation

(1) In order to use all the services available on Voltimum, you must register as a participant. You are not automatically entitled to participation. The service provider is entitled to refuse applications without giving reasons.

(2) You are only allowed to register if you a specialist from the electrical industry, ie an entrepreneur, an employee or trainee with appropriate expertise. Consumers are not allowed access to our information platform.  In the case of a legal entity, the registration must be carried out by a natural person who has unlimited legal capacity and is authorised to represent.

§ 4 Your Registration at Voltimum

(1) The service provider gives you the choice between basic access and premium access. Basic access registration is free of charge. Premium access offers you a significantly extended range of services for a monthly fee. The user fee currently payable for premium access will be displayed during the registration process. More information about the respective service offer can be found under § 8. You can switch from basic access to premium access at any time.

Please note: Since you are applying for access for a purpose that can only be attributed to your commercial or professional activity, you hvae no legal right of withdrawal .

(2) During the registration process, you will be asked to provide an email address, username and password; this is mandatory information. Basic access allows you to voluntarily add additional user data during the sign-up process or at a later date. When registering for paid premium access, additional mandatory information is required; in particular, the name, address and country of the applicant. Contact details and other information requested by the service provider during the registration process must be entered correctly and in its entirety. For the registration of a legal entity, the duly authorised representing individual must also be specified.

(3) Once all information requested has been supplied, the service provider will check for completeness and plausibility. If the information is correct from the perspective of the service provider and if the service provider sees no other concerns with the information, the service provider will grant you access and notify your thereof via email. This email shall be considered acceptance of your request for participation. Upon receipt of the email, you will be authorised to use the portal under these Terms and Conditions. For this purpose, you must first verify your activation by clicking on the link found in the email.

§ 5 Responsibility for the Access Data

(1) With the username or the email address and the password, you can log in to Voltimum at any time after the activation of your access and your confirmation in accordance with § 4 (3). It is your responsibility to ensure that the username does not infringe on third party rights, especially name or trademark rights, and that it does not violate public morals.

(2) You are obliged to keep the access data, including the password, secret and to not make them accessible to unauthorised third parties.

(3) It is your further responsibility to ensure that your access to Voltimum and the use of the services available to Voltimum are performed solely by you or by the persons authorised by you. If you are concerned that unauthorised third parties have gained or will gain knowledge of your access data, please inform the service provider immediately. You are liable in accordance with the law for any use and/or other activity that is performed with/via your access data.

§ 6 Updating Participant Information

It is your responsibility to keep your information (including your contact details) up-to-date. If your data should change at any time throughout the period of your participation, then you must correct the data immediately on Voltimum in your personal settings (under: My profile). If this doesn't work, please inform us of your updated data immediately by email at [email protected]

§ 7 Termination of Participation

(1) You can terminate Voltimum's basic access at any time by unsubscribing from the portal; to do so, send a short email to [email protected]

(2) For Premium Access , a minimum contract period of twelve (12) months applies, starting with the receipt of the email in accordance with § 4 (3). From the expiry of the minimum contract period, the contract is automatically renewed by extension periods of twelve (12) months each,unless a party does not terminate the contract in compliance with a notice period from four (4) weeks before expiry of the minimum contract period or the respective extension period.

(3) This contractual relationship ends on the effective date of the termination of premium access, and thereafter you may no longer access it; you will still be able to use our free basic access. When the termination of the basic access becomes effective, the entire contractual relationship ends and you may no longer use your access to our free services. The service provider reserves the right to block the user name and password when the termination takes effect.

(4) The service provider is entitled to irretrievably delete all data connected to your participation after a period of 30 calendar days from the effective date of termination and after the expiration of any legally mandated record-keeping deadlines.

III. Services and content at Voltimum

§ 8 Services Offered and Availability of Services

(1) The service provider will provide you with different information and other services for temporary use at Voltimum, depending on the access you choose (Basic Access or Premium Access). Such services may include, for example, the provision of specialist articles, instructional videos, practical tips, and other content (hereinafter collectively called "content", see also § 10 (1)), the possibility to create individual profiles and to establish contact with other participants through by submitting personal questions and comments. The content and scope of the services are determined by the respective contractual agreements, otherwise according to the functionalities currently available on the portal. Both free and paid services are available on the portal. Paid services are each marked as such. Regulations on their use can be found in § 12.

(2) The services available at Voltimum may also include third-party services or offers to which the service provider merely provides access. For the use of such services or offers - which are respectively identified as services or offers of third parties - only the terms of contract of these providers apply, for which you are referred to the respective provider. A contract with this provider, for example, about the purchase of a service or a product, arises exclusively between you and the (third) provider and never with the service provider.

(3) The service provider guarantees an availability of 99% on a monthly average within his area of ​​responsibility for the paid Premium access as well as for all paid services (including those that are accessible within the basic access). The service provider is committed to providing its services as seamlessly as possible. However, temporary restrictions or interruptions may occur due to technical disruptions (such as loss of power, hardware and software errors, or technical problems with the data lines).

§ 9 Service Changes

The service provider is entitled to change the unpaid services provided on the portal, to make new, unpaid services available, and to cease the provision of unpaid services at any time. In doing so, the service provider shall duly take your legitimate interests into account.

§ 10 Content Protection, Responsibility for Third Party content

(1) The data, contributions, picture and sound documents, information and other contents (hereinafter referred to collectively "content") available on Voltimum are overwhelmingly protected by the copyright or by other protective rights and are in each case the property of the service provider, the other participants or other third parties who have made the respective content available. As such, the compilation of content may be protected as a database within the meaning of §§ 4, para.2, 87a para.1 UrhG, German Copyright Law). You may only use this content in accordance with these Terms and Conditions and within the framework specified on the portal.

(2) The content available on Voltimum comes partly from the service provider and partly from other participants or other third parties. content from Participants and other third parties is collectively referred to as "third-party content. The service provider does not check Third Party content for completeness, accuracy or legality and assumes no responsibility or liability for the completeness, accuracy, legality or timeliness of Third Party content. This also holds true with regard to the quality of third party content and its appropriateness for a particular purpose and with regard to any third party content on linked, external websites. The contents on Voltimum are usually third-party contents and as such either marked or immediately recognisable; the rest of the content comes from the service provider.

IV. Use of Voltimum Services by You

§ 11 Scope of Permitted Use, Monitoring Usage Activity

(1) Your authorisation for use is limited to access to the portal, as well as the use of the services available on the portal under the provisions of these Terms and Conditions.

(2) You yourself are responsible for meeting the necessary technical prerequisites for contractual use of the services. The service provider is not required to offer any advice on this subject.

(3) The service provider indicates that your usage activity may be monitored to the extent permitted by law. This may potentially include the logging of IP connection data and conversation histories, as well as their evaluation, in the event of a concrete suspicion of a violation of the present Terms and Conditions and/or a concrete suspicion of the existence of any illegal act or offense.

§ 12 Use of paid services

(1) The service provider offers both free and paid services on the portal. Retrieving content can also be be subject to charges. The applicable prices can be found in the respective offer. The use of the services available within the premium access is covered by the monthly usage fee. Insofar as the use of a service (including the retrieval of content) is subject to a charge in the context of basic access, you will receive an online notification of the costs incurred, the terms of payment and the other relevant details before opening access to the respective service. Only then do you have the opportunity to use the respective service by clicking on the corresponding button.

Please note: By clicking on the corresponding button ("order for a fee"), you declare your intention to use the respective service. As a result, you accept our offer about the provision of the paid service binding, and it creates a further contractual relationship. Also for this contractual relationship, the present Terms and Conditions, as well as any other conditions apply, over which the service provider will inform you before using the service. If you do not want to use the paid service, you can return to the free services by clicking on the corresponding button or by clicking on the "back" button on your browser.

(2) Please note: You arrange for the provision of the fee-based service directly by clicking on the corresponding button. Since the use of the service cannot be reversed hereafter and a return of any of your retrieved content cannot be guaranteed in such a way that use after return is no longer possible, you are not entitled to a right of withdrawal regarding the use of paid services .

(3) All stated fees are net prices and include the applicable statutory VAT.

(4) Payment may be made on invoice or direct debit (SEPA) unless otherwise specified in the offer. The respective invoice amount must be transferred to the account specified in the invoice. The payment method options are indicated during the order processing and before sending your order.

§ 13 Creating User Profiles

(1) If available as a function on Voltimum, you can customise your user profile according to your requirements within the scope of these Terms and Conditions. Please note the restrictions in § 16.

(2) The service provider does not normally check the identity of the profile owner or the information contained in the profiles. Therefore, the service provider does not guarantee that each profile corresponds to the person that the respective profile owner claims to be.

§ 14 Setting your Own Content

(1) To the extent that functionality is available on Voltimum, you may, subject to the following provisions, adjust content on Voltimum and make it available to third parties.

(2) By posting content, you grant the service provider a free and transferable right to use the respective content, in particular

  • for the storage of the contents on the server of the service provider and their publication, in particular their public accessibility (eg, by displaying the contents on Voltimum),

  • for editing and copying, as far as this is necessary for the provision or publication of the respective content, and

  • in granting us - for payment - rights of use of your content to third parties according to § 15.

Insofar as you withdraw the content you have posted from Voltimum, the right of use and exploitation granted to us will expire. However, we reserve the right to keep copies for backup and/or verification purposes. The rights of use already granted to the participants in the content you have posted will also remain unaffected.

(3) You are fully responsible for the content you submit. The service provider does not undertake a review of the contents for completeness, accuracy, legality, timeliness, quality and suitability for a particular purpose. You therefore represent and warrant to the service provider that you are the sole owner of all rights to the content you have posted on Voltimum, or that you are otherwise authorised (eg, by an effective permission of the copyright holder) to discontinue use of the content at Voltimum and discontinue use of the content. and exploitation rights in accordance with paragraph (2) above.

(4) The service provider reserves the right to refuse the posting of content and/or to edit, block or remove content already posted without prior notice, if the posting of the content by the participant or the content itself is a violation of § 16 or if there is concrete evidence that there will be a serious violation of § 16. The service provider will, however, take into account your legitimate interests and choose the least intrusive means of preventing a breach of § 16.

§ 15 Right to Use for the Available Content on Voltimum

(1) Unless expressly permitted in these Terms and Conditions or on Voltimum  by a corresponding functionality (eg, a download button),

  • you may only access and display the content available on Voltimum for your own purposes online. This right of use is limited to the duration of your contractual participation in Voltimum;

  • you are not permitted to edit, modify, translate, present or perform, publish, exhibit, reproduce or distribute content available on the portal, either in whole or in part. It is also prohibited to remove or modify copyright notices, logos and other trademarks or protective notices.

(2) You are only entitled to download content ("download") as well as to print out contents as far as there is a possibility for downloading or printing on Voltimum as functionality (eg, by means of a download button).

You will have a non-exclusive right to use all content that has been downloaded or printed in accordance with these provisions for an unlimited period of time for your own, non-commercial purposes. As far as fee-based content that is provided you in the context of basic membership is concerned, further condition for this granting of permission is the complete payment for the respective content. All other rights to the content shall remain with the original rights holder (the service provider or the relevant third party).

(3) Your mandatory statutory rights remain unaffected.

§ 16 Prohibited Activities

(1) The services available on Voltimum are intended for commercial use by the participants.

(2) You are prohibited from any activity on or in connection with our Voltimum portal that violates applicable law, violates the rights of third parties or violates the principles of youth protection. In particular, the following actions are prohibited:

  • the posting, dissemination, offering and advertising of pornographic content, services and/or products that violate child protection laws, data protection laws and/or other law; and/or fraudulent content;

  • the use of content that insults or slanders other participants or third parties;

  • the use, provision and distribution of content, services and/or products that are protected by law or encumbered with third party rights (eg, copyright) without explicit authorisation.

(3) Furthermore, regardless of any possible violation of the law, when you post your own content on Voltimum and when communicating with other participants or third parties (eg, by sending questions, participating in discussion forums, or writing entries), the following activities are prohibited:

  • the dissemination of viruses, Trojans and other harmful files;

  • sending junk or spam mail and chain letters;

  • the dissemination of lewd, offensive, sexually characterised, obscene or defamatory content or messages, and such content or messages that promote or support racism, bigotry, hatred, physical violence or illegal acts, either explicitly or implicitly;

  • the harassment of other participants, eg, through repeated personal contact without or against the reaction of the other participant, as well as promoting and supporting such harassment;

  • asking other participants to disclose their passwords or personal information for commercial or unlawful purposes;

  • the distribution and/or publication of content available on the portal, to the extent that this is not expressly permitted by the respective authors or provided as an explicit functionality on the portal.

(4) You shall also be prohibited from any action which may affect the smooth operation of Voltimum, in particular to unduly burden the systems of the service provider.

(5) If you become aware of any illegal, abusive, illegal or otherwise unauthorised use of Voltimum, please contact us by email at [email protected]. The service provider will then investigate the matter and, if necessary, take appropriate action.

(6) If a suspicion of unlawful or criminal acts exists, the service provider is entitled and possibly also obliged to review your activities and, if necessary, initiate appropriate legal action. This may include forwarding records to the prosecutor.

§ 17 Suspension of Access

(1) The service provider may temporarily or permanently suspend your access to the portal if concrete indications suggest a breach of these Terms and Conditions and/or of applicable law, or if the service provider has a legitimate interest in suspending your account. In deciding whether to suspend an account, the service provider will consider your legitimate interests.

(2) Should a temporary or permanent suspension occur, the service provider shall suspend your access authorisation and notify you thereof via email.

(3) In the event of a temporary suspension, the service provider shall reactivate your access authorisation after the suspension period expires and notify you thereof via email. Permanently suspended access authorisation cannot be recovered. Permanently suspended individuals are permanently excluded from participation in the portal and may not log on to the portal again.

V. Processing your personal data

§ 18 Data Protection

(1) The quality standards of the service provider include the responsible handling of the personal data of participants (hereinafter referred to as "personal data"). Personal data entered during the registration process for the portal, as well as resulting from the use of the available services, will only be collected, stored, and processed by the service provider to the extent necessary for contractual services and to the extent permitted by law or ordered by legislature. The service provider shall treat your personal data confidentially and in accordance with the provisions of the applicable data protection legislation and will not disclose your personal data to third parties.

(2) In addition, the service provider uses your personal data only if you have expressly consented thereto. Your consent may be revoked at any time.

(3) Detailed information on data protection can be found in the data protection section.

VI. Limitation of liability

§ 19 Limitation on Liability for Unpaid Services

Should you suffer damages through the use of unpaid services provided on the portal (including the retrieval of free content), the service provider is only liable if said damages were caused in the scope of contractual use of the free content and/or services as a result of wilful misconduct (including malice) or gross negligence on the part of the service provider, or if the service provider's liability is established due to product liability claims.

§ 20 Limitation of liability for paid services

In the context of the use of paid services (including the retrieval of paid content) by you, the service provider is liable in accordance with the following provisions:

(1) The service provider is liable without limitation for damages caused intentionally or through gross negligence by the service provider or his legal representatives, executives or simple vicarious agents.

The provider is not liable in cases of slightly negligent violation of only insignificant contractual obligations. Furthermore, the provider's liability for damages caused by the slight negligence is limited to those damages such as are typically associated and foreseeable with contractual relationships of this kind. This also applies to slightly negligent breaches of duty by the legal representatives, executives or vicarious agents of the service provider.

(3) The above limitation of liability does not apply in the case of malice, in the case of bodily injury or personal injury, for the violation of warranties as well as for claims arising from product liability.

VII. Other/miscellaneous provisions

§ 21 Written form requirement

Unless otherwise expressly indicated in these Terms and Conditions, all statements that are made with regard to participation in the portal must be submitted in written form or by email. The email address of the service provider is [email protected]. The postal address of the service provider is:

Contact information is subject to change. The service provider shall inform you of any such changes.

§ 22 Severability Clause

If any provision of these Terms and Conditions shall be or become invalid, the validity of the remaining provisions shall remain unaffected. The parties shall agree to replace the invalid provision with a valid provision that most closely fulfils the economic intentions of both parties.

§ 23 Governing Law

These Terms and Conditions are governed by the laws of the Federal Republic of Germany, excluding the UN Sales Convention (Convention of Contracts for the International Sale of Goods, CISG).

§ 24 Jurisdiction

The exclusive venue for any disputes arising out of these Terms and Conditions is the registered office of the service provider, insofar permissible.
